1. Acceptance of terms

By accessing or using the MOTIQ website and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of service

MOTIQ provides a vehicle buying service. We evaluate vehicles submitted through our website, make purchase offers, and arrange for inspection, pickup, and payment. We are not a marketplace or auction site — we buy vehicles directly from private sellers.

3. Eligibility

To use our services, you must:

  • Be at least 18 years of age
  • Be the legal owner of the vehicle or authorized to sell it
  • Provide accurate and truthful information about the vehicle
  • Have the legal capacity to enter into binding contracts

4. Vehicle submissions

When you submit vehicle information through our website, you agree to provide accurate, current, and complete information. MOTIQ reserves the right to reject any submission or rescind an offer if the vehicle condition or documentation does not match the information provided.

5. Disclaimer of warranties

MOTIQ provides its website and services on an "as is" and "as available" basis. We make no warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or that our services will be uninterrupted, timely, secure, or error-free. You use our services at your own risk.

6. Text messaging terms

By providing your mobile phone number and checking the consent box on our form, you consent to receive text messages from MOTIQ regarding your vehicle inquiry and sale.

Consent: You consent to receive both non-marketing messages (related to your transaction) and, if separately opted in, marketing messages (promotional offers and updates).

Frequency: Message frequency varies. Transaction-related messages typically range from 1-5 per sale. Marketing message frequency is occasional.

Costs: Message and data rates may apply based on your wireless carrier and plan.

Opt-out: You may opt out of text messages at any time by replying STOP to any message. You will receive one final confirmation message and then no further texts. Opting out of marketing messages does not opt you out of transaction-related messages necessary to complete your sale.

7. Carrier liability disclaimer

MOTIQ is not responsible for the delivery, receipt, timing, or content of text messages sent through third-party wireless carriers, telecommunications providers, SMS gateways, or messaging platforms. Message delivery is subject to carrier network availability, coverage, and technical limitations outside of MOTIQ's control.

MOTIQ expressly disclaims all liability for any loss, damage, or delay arising from: carrier network outages; message delays, failures, or nondelivery; incorrect routing; or any act or omission of any wireless carrier, telecommunications provider, or intermediary involved in message transmission. You acknowledge that wireless carriers may charge standard messaging rates and that such charges are solely between you and your carrier.

8. Offers and pricing

All offers made by MOTIQ are preliminary and subject to physical inspection of the vehicle. The final purchase price may be adjusted based on the actual condition of the vehicle, title status, and other factors. Offers expire unless accepted within the specified timeframe.

9. Vehicle pickup and payment

MOTIQ will arrange pickup at a mutually agreed time and location. Payment is issued at the time of pickup, subject to successful verification of title and ownership. If you owe money on the vehicle, we will work with your lender to arrange payoff.

10. User conduct

You agree not to:

  • Provide false or misleading information about a vehicle
  • Submit information for vehicles you do not own or are not authorized to sell
  • Use our service for fraudulent or illegal purposes
  • Interfere with the proper functioning of our website
  • Attempt to gain unauthorized access to our systems

11. Limitation of liability

MOTIQ is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability shall not exceed the amount paid for the vehicle in question.

Under no circumstances shall MOTIQ, its owners, employees, or affiliates be liable for any loss or damage arising out of or in connection with your use of our website or services, including but not limited to errors, omissions, interruptions, defects, delays in operation or transmission, computer viruses, or line failures, even if advised of the possibility of such damages.

12. Indemnification

You agree to indemnify and hold harmless MOTIQ and its representatives from any claims, damages, or expenses arising from your use of our services, your violation of these terms, or your violation of any third-party rights.

13. Changes to terms

We may modify these Terms of Service at any time. Changes will be effective immediately upon posting to this page. Your continued use of our services constitutes acceptance of the modified terms.

14. Governing law

These Terms of Service are governed by the laws of the State of New Jersey, without regard to its conflict of law principles.

15. Privacy policy
